Terms of Use

Effective date: 13 July 2026

These Terms of Use (“Terms”) form an agreement between you and Razvan Similea (“we”, “us”) governing your use of the Zvelt mobile application (the “App”). By downloading or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use, subject to these Terms and the rules of the app store you downloaded it from.

2. Eligibility

You must be at least 16 years old to use the App.

3. Your account & conduct

You are responsible for your account and for keeping your credentials secure. You agree not to misuse the App, including: submitting false performance data or attempting to manipulate rankings; harassing other users; uploading unlawful, infringing or offensive content; or interfering with the security or operation of the service. We may moderate content and suspend or terminate accounts that violate these Terms.

4. User content

You retain ownership of the content you create (workouts, posts, comments, photos). You grant us a worldwide, royalty-free licence to host, store, and display that content solely to operate and provide the App to you and, where you choose, to your friends. You are responsible for the content you share and confirm you have the rights to it.

5. Subscriptions (Zvelt Pro)

Zvelt offers an optional auto-renewable subscription, Zvelt Pro, that unlocks additional features. Key terms:

Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period.
You manage and cancel your subscription in your App Store or Google Play account settings — not inside the App.
Prices are shown in the App before purchase and may vary by region; any free-trial terms, if offered, are disclosed at the point of purchase.
Refunds are handled by Apple/Google under their policies; we do not process store payments directly.

6. Health & safety disclaimer

Zvelt is a fitness tracking tool, not a medical device or a source of medical advice. Exercise carries inherent risks. Consult a qualified physician before starting any exercise program, especially if you have a health condition or injury. Rankings, suggestions and progression cues are informational only. You use the App and perform any exercise at your own risk.

7. Intellectual property

The App, its design, and its content (excluding your user content) are owned by us and our licensors and are protected by law. You may not copy, modify, reverse engineer, or create derivative works except as permitted by law.

8. Disclaimers & limitation of liability

The App is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate access if you breach these Terms or where required by law.

10. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections in your country of residence.

11. Apple App Store — additional terms

If you downloaded the App from the Apple App Store, the following also apply:

These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App; we are solely responsible for support.
In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
We (not Apple) are responsible for addressing any claims relating to the App, including product-liability, legal/regulatory, and intellectual-property claims.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government restricted-parties list.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes

We may update these Terms; we will revise the “Effective date” above and, for material changes, notify you in the App. Continued use after changes means you accept them.
